Eligibility Requirements

• You must have the legal capacity to enter into a binding agreement in your jurisdiction.
• You must not be prohibited from using our Service under applicable laws.
• You must provide accurate and complete registration information.

Account Responsibilities

• Username Selection: Your username must be appropriate, non-offensive, and comply with our community guidelines. We reserve the right to reject or change usernames that violate these standards.
• Password Security: You are responsible for maintaining the confidentiality of your password and account credentials. Your password must be at least 6 characters long.
• Account Activity: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
• Single Account Policy: Each user may maintain only one active account. Creating multiple accounts is prohibited.

Third-Party Authentication

You may register using third-party services such as Google, Apple, or Facebook. By doing so, you authorize us to access certain information from these services as permitted by your privacy settings on those platforms.

Core Features

Service Availability

We strive to maintain continuous availability of our Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical issues or server problems
• Force majeure events beyond our control
• Security concerns or emergency situations

Content Ownership

You retain ownership of your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

Content Standards

You agree that your User Content will not:

• Be false, misleading, or deceptive
• Infringe on any third party's intellectual property rights
• Contain viruses, malware, or harmful code
• Be obscene, offensive, or inappropriate
• Promote illegal activities or violence
• Harass, bully, or intimidate other users

Prohibited Activities

You may not:

• Cheating: Use unauthorized scripts, bots, or third-party tools to gain unfair advantages in competitions.
• Account Manipulation: Create fake accounts, share accounts, or manipulate rankings.
• System Exploitation: Attempt to exploit bugs, glitches, or vulnerabilities in the Service.
• Network Abuse: Engage in denial-of-service attacks or other activities that disrupt the Service.
• Data Mining: Scrape, harvest, or collect data from the Service without authorization.
• Impersonation: Impersonate other users, KickLang staff, or any third party.
• Commercial Use: Use the Service for unauthorized commercial purposes or advertising.

Fair Competition

To ensure fair competition for all users:

• Compete honestly and respect your fellow learners
• Report any suspicious activity or cheating you observe
• Accept match results and rankings without manipulation
• Maintain good sportsmanship in all interactions

Premium Features

Premium subscriptions may include:

• Unlimited hearts/lives for continuous learning
• Ad-free experience
• Exclusive content and advanced lessons
• Priority matchmaking in competitions
• Detailed analytics and progress insights

Billing Terms

• Payment Processing: All payments are processed through Apple App Store or Google Play Store. We do not directly collect or store your payment information.
• Subscription Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Price Changes: We reserve the right to change subscription prices with reasonable notice to existing subscribers.
• Refunds: Refund requests are handled according to the policies of the respective app store.

Virtual Currency and Items

Any virtual currency, items, or rewards earned or purchased within the Service have no real-world monetary value and cannot be exchanged for cash. These items are licensed to you and may be modified or removed at our discretion.

Our Intellectual Property

• The KickLang name, logo, and all related graphics and trademarks
• The Service's software, algorithms, and underlying technology
• All educational content, questions, and learning materials
• The user interface, visual design, and user experience elements
• All documentation, marketing materials, and communications

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes, subject to these Terms. This license does not include:

• The right to modify, copy, or create derivative works
• The right to reverse engineer or decompile the software
• The right to sublicense or transfer your rights
• Any ownership interest in the Service or its content

Data We Collect

• Account Information: Email address, username, password, and profile data
• Learning Data: Your progress, scores, competition results, and learning patterns
• Device Information: Device type, operating system, and unique identifiers
• Usage Data: How you interact with the Service, features used, and session duration

How We Use Your Data

We use your data to:

• Provide and personalize the Service
• Process transactions and manage subscriptions
• Communicate with you about updates and features
• Improve our Service through analytics
• Ensure security and prevent fraud
• Comply with legal obligations

Termination by You

You may delete your account at any time through the app settings. Upon deletion:

• Your account and profile will be permanently removed
• Your learning progress and achievements will be deleted
• Active subscriptions should be cancelled separately through your app store
• Some anonymized data may be retained for analytics purposes

Termination by KickLang

We may suspend or terminate your account if:

• You violate these Terms or any applicable policies
• Your use of the Service poses a security risk
• We are required to do so by law
• We discontinue the Service or any part thereof

Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

Educational Disclaimer

KickLang is a supplementary language learning tool. We do not guarantee any specific learning outcomes, language proficiency levels, or certification preparation. The Service should not be relied upon as the sole method of language education.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account
• Damages resulting from any interruption or cessation of the Service
• Damages resulting from any bugs, viruses, or errors in the Service

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KickLang operates, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and KickLang regarding your use of the Service.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of KickLang.
